Food Fights, Corporate Trade Agreements, and States’ Rights: Democracy or Corporatocracy?

Along with campaigns against fracking and climate change, perhaps the largest and most dynamic grassroots movement in North America today is the anti-genetic engineering, Millions Against Monsanto food movement.

Last May and October, as part of a global “March Against Monsanto,” over a million protestors, many for the first time, marched and picketed in hundreds of cities and towns across North America, calling for mandatory labels or bans on GMOs (Genetically Modified Organisms).

In Mexico, a massive coalition of over 300 urban, rural and indigenous organizations have successfully mobilized public opinion and the Federal courts to ban, at least temporarily, the commercial planting of Monsanto’s genetically engineered corn and other GMOs.

In Canada, the Canadian Biotechnology Action Movement (CBAN), the organic food community and environmental groups are protesting against the spread of GM corn, canola, soy and sugar beets, and suing the government over the legalization of a new, highly controversial, genetically engineered salmon that threatens the livelihoods of traditional fishing and indigenous communities.

Meanwhile in the U.S., the heartland of genetic engineering and industrial/chemical agriculture, a growing corps of organic and natural health activists, utilizing state and county ballot initiatives, grassroots legislative lobbying, consumer boycotts and street protests, have forced Monsanto, the biotech industry, and the Grocery Manufacturers Association (GMA) to go the defensive.

USA Food Fight over GMOs Intensifies

Confronted in the U.S. with the inevitability of mandatory state GMO food labeling laws—laws that will likely, as in Europe, drive GMOs off supermarket shelves—industrial food and biotech corporations are in a panic. After being forced to spend $70 million, and then barely defeating (51-49%) two citizen ballot initiatives in California and Washington State, Big Food and biotech’s front group, the GMA is facing criminal charges in Washington State for illegally laundering over $11 million in campaign donations. The GMA engaged in this blatant money laundering to shield its members, Big Food Inc. and their brands, including Coca-Cola (Honest Tea and Odwalla), Pepsi (Frito-Lay and Naked Juice), General Mills (Cheerios, Muir Glen, Cascadian Farm), Kellogg’s (Kashi), Kraft, Dean Foods (Horizon, White Wave), from consumer wrath and marketplace boycotts over the GMO labeling issue.

Sensing defeat in upcoming ballot initiatives and legislative labeling battles in Vermont, Oregon and other states, the GMA and the factory farm lobby recently tried to insert a controversial clause into the 2013-18 Farm Bill. The “King Amendment,” named for its author, Rep. Steve King (R-Iowa), would have taken away the long-established right of states to regulate agricultural production practices in their jurisdictions, likely undermining future mandatory labeling of GMOs, and meat and other products produced on factory farms. A massive coalition of animal welfare, organic and anti-GMO networks, supported by numerous state legislators and state Attorney Generals, led by the Humane Society of the U.S., (HSUS) helped convince the U.S. Senate to kill the King Amendment in January. A similar anti-consumer, anti-right-to-know Farm Bill amendment to nullify mandatory “Country of Origin” labeling for meat, fish, produce and nuts failed at the same time.

Frontline Battles in Oregon

In Oregon, where a decisive GMO labeling ballot initiative will go before voters in November 2014, and several counties have proposed GMO bans, the battle lines have been clearly drawn. Threatened by 2014 ballot initiatives in four counties calling for the banning of genetically engineered crops, the Governor and pro-biotech legislators, in October 2013, rammed through a last-minute provision designed to strip counties and local communities of the right to ban or restrict the growing of GMO crops. SB 633, dubbed the “Oregon Monsanto Protection Act” by critics, is part of the final 2013 state appropriations bill. Specifically, SB 633 prohibits local governments from enacting or enforcing any measures that “regulate agricultural, flower, nursery and vegetable seeds or their products.”

Jackson County, Ore., which had already qualified a GMO ban initiative for the May 2014 ballot prior to the passage of SB 633, was exempted from the Monsanto Protection Act. As a result, Jackson County will be at the center of a crucial community rights vs. corporate rights battle in May.

But Jackson County may not be going it alone. Angered by Monsanto and agribusiness stomping on their traditional community rights, residents in three other Oregon counties—Benton, Lane, and Josephine—are attempting to place initiatives on the ballot that would nullify the Oregon Monsanto Protection Act, and affirm that community rights, not corporate rights, should be sovereign under the law.

A similar battle over community rights and home rule is unfolding in Hawaii, where a grassroots-powered Kauai county ordinance has placed heavy restrictions on GMOs and pesticide corporations, and where Hawaii County (Kona) has passed an outright ban on new GMO crops. Six counties in the U.S. have now banned the planting of GMOs—four in California (Mendocino, Marin, Trinity, and Santa Cruz); one in Washington State (San Juan County); and one in Hawaii (Kona). In addition, a number of cities and towns in Maine, Colorado and California have banned genetically engineered crops.

Industry Fights Back against Community Rights Movements

Approximately 1,000 counties in the U.S. have explicit authority in their state constitution to allow and uphold citizen ballot initiatives. Fearing that more and more counties will launch these initiatives, factory farm and biotech interests in at least a dozen states have passed so-called “Right-to-Farm” legislation designed to protect the interests of corporate agribusiness, over those of local citizens. And in Hawaii and Jackson County, Ore., where there are active initiatives in play, the biotech industry and the Farm Bureau are now pouring money into campaigns to defeat those initiatives.

In late 2013, the powerful GMA began lobbying the U.S. Food & Drug Administration (FDA), and now Congress to eliminate states’ rights to pass GMO labeling laws on GMOs. The GMA, according to leaked documents, is pleading with the FDA to derail the growing anti-GMO movement with “voluntary” federal labeling, make-believe safety monitoring, and legalization of the widespread industry practice of fraudulently advertising and labeling GMO-tainted foods as “natural” or “all natural”—steps so outrageous that even FDA bureaucrats appear stymied, given the present level of public anger and concern.

Compounding their reputation as ruthless bullies, the biotech industry and GMA lobbyists continue to threaten states like Vermont, New Hampshire, Maryland, and Oregon with expensive lawsuits if they dare pass GMO labeling laws.

While heavily-armed St. Louis police were arresting “Occupy Monsanto” protestors outside corporate headquarters, and a shareholder resolution was introduced for the company to support GMO labeling, the embattled CEO of Monsanto, Hugh Grant, sheepishly admitted to investors on January 28, “We simply haven’t engaged enough at the level we should have with all of our audiences, and for that, we apologize… we need to do more.”

In the same week, Wired magazine and Mother Jones both reported that Monsanto is apparently giving up on marketing new gene-spliced vegetable and grain crops (except for dicamba-resistant soybeans and RNAi corn), opting instead for high-tech, and less controversial “marker assisted” crossbreeding.

Other major biotech corporations such as Syngenta, Bayer, Dow, BASF, and Dupont are following this same path, investing the bulk of their research and development in marker-assisted breeding, rather than genetic engineering.  As Mother Jonesand Wired explain, Monsanto spokespersons admit that they have no new gene-spliced vegetables under development, reverting “instead to good old-fashioned crossbreeding, the same technology that farmers have been using to optimize crops for millennia."

Crushing Local Democracy with Corporate Trade Agreements

Fearing the spread of citizen activism, ballot initiative and community rights ordinances, major food corporations and biotech firms, joined by Big Pharma, multinational banks, and the fossil fuel industry, have been single-mindedly lobbying for approval of several new sweeping, secretly-negotiated international trade agreements, the Trans-Pacific Partnership (TPP), and the Trans-Atlantic Free Trade Agreement (TAFTA). These agreements, full of anti-consumer and anti-worker provisions, also grant multinational corporations the sovereign right to nullify local, state and national food labeling, food safety, Fair Trade, Buy Local, labor rights, indigenous, and environmental protection laws. In an unprecedented demonstration of North American and international solidarity and online/grassroots action, a broad coalition of anti-GMO, environmental, Fair Trade, and labor activists seem to have derailed the TPP and TAFTA, at least for the moment, preventing President Obama from ramming the TPP through Congress, utilizing so-called “Fast Track” authority.

From the activist standpoint, the recent victories on the GMO and TPP “fast track” fronts are welcome news. A critical mass of millions of people, informed, determined and united—online and on the ground, locally, regionally, nationally, and internationally—are proving, through collective action, that “we the people” can indeed battle, and at times, defeat the Corporatocracy and its indentured politicians, PR flacks and media minions.

The growing strength of this “Movement of Movements” provides hope in desperate times, that by aggressively framing issues, capitalizing on divisions among the elite, utilizing the power of social media, building broad coalitions, carrying out boycotts, mobilizing street protests, and engaging in direct democracy tactics that bypass corrupt federal government officials and politicians (by using county and state ballot initiatives), the global grassroots can begin to overcome the dictatorship of Monsanto and the Corporatocracy.

The broader hope is that this embryonic Movement of Movements can rise to the occasion and continue to win over the hearts and minds of the majority, addressing, not only crucial issues of food and farming and public health, but also related life or death issues such as climate change, economic justice, and militarism.

But to do this we must connect the dots between the different struggles, not only struggling for the right to know whether the food we are eating is genetically engineered or factory-farmed, but for democracy, health and sustainability on all fronts. Without campaign finance reform, without breaking the stranglehold of large corporations and the wealthy over the media, the federal government and the judiciary, there can be no democracy. Without dismantling the bloated infrastructure of the military-industrial complex and bringing to heel the Shadow Government of the CIA and NSA, there can be no liberty, nor the financial resources to address our life or death issues.

Without challenging the outrageous legal doctrine of “corporate personhood,” whereby corporations have more rights than the people, Americans and people everywhere will remain disenfranchised.

And without restoring and maintaining a balance of powers between nation states and transnational corporations; nation states and indigenous communities; federal governments, states and local home rule counties and municipalities; there can be no republic. Only a Corporatocracy, an unholy alliance and dictatorship of indentured politicians, media minions, and profit-at-any-cost corporations—driving us headlong toward climate catastrophe and economic collapse.

The battle to build a 21st Century democracy and overthrow the Corporatocracy is a battle we cannot afford to lose.

As mounting evidence shows genetically modified foods have dangerous health and environmental repercussions, the number of scientists willing to step forward and speak out against them is similarly growing. Dr. Thierry Vrain is just the latest of many scientists to buck Monsanto and their hired goons, changing his stance on GMOs and shouting their dangers to anyone that will listen.
Dr. Vrain is a former research scientist for Agriculture Canada. It was his job as scientist of his institute to address the public and others, assuring them of the safety of genetically engineered crops and foods. Now, 10 years after his retirement, he’s changed his tune.
“In the last 10 years I have changed my position. I started paying attention to the flow of published studies coming from Europe, some from prestigious labs and published in prestigious scientific journals, that questioned the impact and safety of engineered food."

"I refute the claims of the biotechnology companies that their engineered crops yield more, that they require less pesticide applications, that they have no impact on the environment and of course that they are safe to eat.”

The studies commissioned by Monsanto understandably come to the conclusion that genetically modified foods and crops are both safe for the environment and safe for people. They are commissioned by the people who want that outcome. Studies from objective researchers, however, often come to very different conclusions. Read: 800 Scientists Demand Global ‘GMO Experiment” to End Vrain says we should take these studies seriously and demand that our governments replicate the studies rather than take the word of biotech giants like Monsanto. 

“The Bt corn and soya plants that are now everywhere in our environment are registered as insecticides. But are these insecticidal plants regulated and have their proteins been tested for safety? Not by the federal departments in charge of food safety, not in Canada and not in the U.S.” Long-term feeding studies on these foods simply don’t exist. 

We do, however, have studies that indicate disastrous outcomes in rats, where animals fed genetically engineered foods die prematurely. Vrain argues that the entire paradigm of genetic engineering being used in GMO technology is flawed. “Genetic engineering is 40 years old. It is based on the naive understanding of the genome based on the One Gene – one protein hypothesis of 70 years ago, that each gene codes for a single protein. The Human Genome project completed in 2002 showed that this hypothesis is wrong.”

Researchers like Dr. Vrain come forward to voice their opposition to genetically modified foods, we can hope governments and consumers alike will pay attention and demand accountability from corporations like Monsanto.

The Natural Products Association, which represents more than 2,000 health food, supplement and beauty companies, has officially endorsed bipartisan legislation to label genetically engineered foods, introduced by Senator Boxer and Rep. DeFazio earlier this year.  The NPA is the first of its kind to endorse GE labeling legislation, citing the bill as "an important first step to address this issue that is very important to the everyday consumer." Read More >>

I-522, a ballot inititiative in Washington State to require labeling of genetically engineered foods, has already garnered strong public support and funding from organic and liberal groups. However, the same agribusiness and food industry giants that defeated Prop 37 in California last year are beginning to pour money into an opposition campaign, creating what looks to be another David vs. Goliath battle. Read More >>


Both Connecticut and Maine recently passed labeling legislation; however, in order to enact the laws, surrounding states, such as New York, will have to follow suit. A public hearing has been scheduled for the end of the month by New York's Assembly Committee on Consumer Affairs and Protection to debate a bill that would require manufacturers to label genetically engineered products. Read More >>



Facing tight restrictions on genetically engineered foods in the European Union, Monsanto will be withdrawing its requests for approval of seven GE maize, soybean and sugar beet crops in the coming months. Only three GE varieties have ever been given the green light for cultivation in the E.U. According to a Monsanto spokesperson, the company plans to instead focus on securing approval for GE imports to Europe from the U.S. Read More >>

Monsanto's unsavory behavior even resulted in Forbes Magazine's retraction of naming Monsanto "Company of the Year" in 2009, admitting they were "wrong on Monsanto... really wrong," citing not only the problems with resistant superweeds but also investigations of antitrust issues and a potential flop in an expensive new variety of GE corn seed. But these high-tech seed wars have now gone global, extending well beyond our Western borders, and there is no better illustration than the latest scandal in India.

GE Scientists in India Found Guilty of Fraud and Cover Up

A group of scientists from the Indian Council of Agricultural Research (ICAR) and the University of Agricultural Sciences (UAS) have been found guilty of infecting and subsequently hiding the fact that indigenously created Bt cotton contained a Monsanto gene1. The variety, called BNBt, was supposed to be a cheaper alternative to the other Indian Bt cotton hybrids. Shortly after its release in 2009, its sales were suspended, and then hearings commenced.
It's now been determined that the Indian scientists intentionally contaminated the GE cotton seed, because "accidental contamination cannot explain what happened." ICAR condemned the scientists' actions as "unethical, unscientific, and irresponsible." It appears these shenanigans occurred in order to somehow speed up the seed's release into India's Bt cotton marketplace.2
The hearing's outcome falls on the heels of a major decision in October 2012 by a committee, appointed by India's Supreme Court, to end all GE field trials until certain conditions have been met. The Committee also recommended a 10-year moratorium on field trials of all Bt food crops and a moratorium on field trials of herbicide-tolerant crops until an independent assessment has performed.
Perhaps India has finally had enough. Over the past 16 years, more than a quarter of a million Indian farmers have committed suicide after being convinced to plant Monsanto's genetically engineered seeds (especially Bt cotton), then having their crops fail, leaving them in financial ruin. Could this be a harbinger of times to come in the United States?

Latest Study Shows Roundup Creates Botulism Breeding Ground in Poultry

A new German study3 by the Institute of Bacteriology and Mycology examined the effects of glyphosate, the active agent in Monsanto's herbicide Roundup, on the gut microbes of poultry. Some birds are heavily exposed to glyphosate when fed genetically engineered feed. The study's findings are quite alarming. Researchers found that highly pathogenic bacteria resisted glyphosate, whereas beneficial bacteria likely succumbed to it.
What does this mean for you and me?
The essential implication is that poultry fed GE corn or soy would fall victim to dysbiosis, meaning unhealthy changes in their gut flora that threaten the health of the birds, as well as anyone consuming them. The good bacteria in the poultry gut, such as Enterococcus, Bifidobacterium and Lactobacillus, are killed off, allowing the pathogenic or disease causing bacteria to flourish. Varieties such as Salmonella and Clostridium are very dangerous pathogens for humans. Clostridia bacteria are some of the deadliest, with strains including C. tetani (tetanus) and C. botulinum (botulism).
Chickens bred in CAFOs are already routinely fed antibiotics, arsenic, and even antidepressants, all of which have serious adverse health consequences. But this new study suggests CAFO chickens exposed to glyphosate may become breeding grounds for Botulism, Salmonella and other major pathogenic organisms.4
The implications of this become even clearer when you consider the recently released findings of a decade-long feeding study that showed GE feed can cause significant changes in the digestive systems, immune systems, and major organs (including liver, kidneys, pancreas, genitals and others) of rats, mice, pigs and salmon. If it's doing all of that to animals and fish, what's it doing to you? Clearly, the conventional agribusiness food system has emerged as a major threat to your health. But it may also be contributing to an even greater problem: the destruction of the world's topsoil.

The World is Running Out of Topsoil

The world may be running out of usable topsoil, the layer that allows plants to grow. According to an article in Time World5, soil erosion and degradation rates suggest we have only about 60 remaining years of topsoil. Forty percent of the world's agricultural soil is now classified as either degraded or seriously degraded; the latter means that 70 percent of the topsoil is gone. Our soil is being lost at 10 to 40 times the rate it can be replenished, and our food production systems are to blame, which epitomizes the term "unsustainable." It takes decades or even centuries to regenerate significant levels of soil.
Agriculture accounts for 70 percent of our fresh water use. When the soil is unfit, water is wasted—it washes right through the soil and past the plant's root system. We already have a global water shortage that's projected to worsen over the next 20 to 30 years, so this is the last thing we need to compound it. Soil degradation is projected to cause 30 percent loss in food production over the next 20 to 50 years—while our global food demands are expected to increase by 50 percent over this span of time.
Many don't realize that soil is alive and has an incredible diversity of microorganisms. One handful of soil contains more microbes than the number of people who have ever lived on our planet.
These organisms create a powerful synergy with the plants and recycle organic material, making the soil more resilient and better at holding water and nutrients, and better at nurturing plants. Microbes need carbon for food, and we're depleting our soil of this element by using chemical fertilizers, overgrazing, over-ploughing, and burning stubble in fields to accelerate crop turnover. Add to this genetically engineered crops, and our soil is dealt another deathblow.

GE Crops Help Destroy Soil Fertility—Possibly Irreversibly

The latest science seems to suggest genetically engineered plant cultivation may seriously disrupt soil ecology by reducing microbial diversity, which decreases soil fertility over time—possibly irreversibly.6
As GE plants increasingly take over the major food-producing areas of the world, including the U.S., China, India, Argentina and Brazil, reduced soil fertility could lead to famine on a scale never previously seen. The mechanisms for this are just beginning to be understood, and what was recently only theory has inched closer to reality as science shines more light on the consequences of introducing genetically engineered organisms into the soil.
The mechanism goes something like this...
Special genetic elements (vector DNA) are present in all GE plants. This vector DNA enables unrelated microorganism species to mate, but can also be transferred to soil microorganisms. Soil fertility depends on the presence of a diverse blend of microorganisms, all serving different roles in balancing and optimizing the soil. But when unrelated species mate, the soil ecosystem loses diversity, which is proven to damage fertility.
Until recently, the transfer of genes between GE plants and soil bacteria was only theoretical. However, this mechanism has now been demonstrated by science, and it's our soil's worst nightmare. It should be noted that this same process of gene transfer has been shown to occur in your gastrointestinal tract when you eat GE foods—turning your intestines into a virtual pesticide factor.

Horizontal Gene Transfer Is Now Proven By Science
The following complications underscore the seriousness of the dangers introduced by cultivation of GE crops:
  • DNA from GE plants is not readily broken down in the soil and can be taken up by soil particles and microbes. The accumulation of foreign DNA may lead to a cumulative loss of soil diversity over repeated harvests.
  • Unlike the claims of Monsanto when it first approved GM crops, Bt genes (Bacillus thuringiensis) are not broken down, for the reasons already stated, so can accumulate in soil and potentially produce Bt toxins. These toxins may build up in the soil, further damaging the organisms crucial for soil fertility. Research from the New York University7 confirms that Bt toxins are not broken down by soil microbes and do indeed accumulate in soil; the toxins maintain their ability to kill insects, potentially creating superbugs that further endanger the ecosystem.
  • GE DNA is able to merge with the DNA of other organisms to create new varieties of soil microorganisms that disrupt the ecological balance. These new organisms, if virulent enough, could spread widely via wind erosion and ground water to compromise soil fertility on a broader scale.
  • A Swiss study8 showed that adult earthworms feeding on transgenic Bt corn lost 18 percent of their initial weight, suggesting GE DNA may have long-term toxic effects on earthworms. Earthworms are major decomposers of dead and organic matter in the soil and are major contributors to the recycling of nutrients. An earlier study9 showed that both earthworms and collembolans (another small soil-dwelling invertebrate) can be adversely affected by Bt crops.
  • Its also been shown that glyphosate can be toxic to rhizobia, a nitrogen-fixing bacterium10. Nitrogen fixing bacteria are important because nitrogen is the nutrient most commonly deficient in soil.
GE crops are adversely affecting our soil biology in numerous ways. There are differences observed in the bacteria occupying plant roots and changes in nutrient availability. Many studies show glyphosate can have toxic effects on microorganisms and can stimulate them to germinate spores and colonize root systems. Glyphosate has also been shown to immobilize manganese, an essential plant nutrient. Overall, glyphosate diminishes the health and nutritional value of the plants it's sprayed on, as well as the soil.
The two main types of GE foods—herbicide-tolerant crops and pesticide-producing crops—are both imprecise technologies riddled with unintended consequences, including hundreds to thousands of genetic mutations that have unknown effects on human health. Keep Fighting for Labeling of Genetically Engineered Foods

While California Prop. 37 failed to pass last November, by a very narrow margin, the fight for GMO labeling is far from over. The field-of-play has now moved to the state of Washington, where the people's initiative 522, "The People's Right to Know Genetically Engineered Food Act," will require food sold in retail outlets to be labeled if it contains genetically engineered ingredients. As stated on LabelitWA.org:
"Calorie and nutritional information were not always required on food labels. But since 1990 it has been required and most consumers use this information every day. Country-of-origin labeling wasn't required until 2002. The trans fat content of foods didn't have to be labeled until 2006. Now, all of these labeling requirements are accepted as important for consumers. The Food and Drug Administration (FDA) also says we must know with labeling if our orange juice is from fresh oranges or frozen concentrate.
Doesn't it make sense that genetically engineered foods containing experimental viral, bacterial, insect, plant or animal genes should be labeled, too? Genetically engineered foods do not have to be tested for safety before entering the market. No long-term human feeding studies have been done. The research we have is raising serious questions about the impact to human health and the environment.
I-522 provides the transparency people deserve. I-522 will not raise costs to consumers or food producers. It simply would add more information to food labels, which manufacturers change routinely anyway, all the time. I-522 does not impose any significant cost on our state. It does not require the state to conduct label surveillance, or to initiate or pursue enforcement. The state may choose to do so, as a policy choice, but I-522 was written to avoid raising costs to the state or consumers."
Remember, as with CA Prop. 37, they need support of people like YOU to succeed. Prop. 37 failed with a very narrow margin simply because we didn't have the funds to counter the massive ad campaigns created by the No on 37 camp, led by Monsanto and other major food companies. Let's not allow Monsanto and its allies to confuse and mislead the people of Washington and Vermont as they did in California. So please, I urge you to get involved and help in any way you can, regardless of what state you live in.
